General Terms and Conditions (GTC)
§ 1 Scope of Application
-All services provided by me as a tattoo artist Elina Swan are rendered exclusively on the basis of these General Terms and Conditions (GTC).
– These GTC apply regardless of whether the tattoo is carried out in a permanent studio, a residency studio, or as a guest artist.
§ 2 Appointment Booking, Deposit, Cancellation and Compensation
– Appointments can be requested via the contact options provided by me. These include: contact form on my website, email, WhatsApp, or direct message via Instagram.
– With your request, please provide all relevant information regarding your desired tattoo (idea, size, placement, and references if applicable). Based on this, I will estimate the scope of the project and provide a non-binding price indication.
– An appointment is considered binding only once it has been confirmed by you through the payment of a deposit. Upon receipt of the deposit, a binding appointment agreement is concluded. At the same time, you accept these GTC as the contractual basis.
– Please make sure to allow sufficient time for your appointment. Each tattoo is a custom-made piece and may take several hours depending on the design.
– The deposit serves both as an appointment security and as compensation for the preparatory design work. It is generally non-refundable, but may alternatively be issued as a voucher upon request.
– The amount of the deposit depends on the scope of the project and will be deducted from the total price at the final tattoo appointment.
– The deposit can be paid by bank transfer or in cash following a personal consultation at the studio.
– If you are unable to attend your appointment, cancellation must be made at least 48 hours prior to the scheduled appointment. In the event of a late cancellation or no-show, the deposit will be retained as compensation for lost income. In this case, a replacement appointment may be scheduled, which will require a new deposit.
– If I am required to cancel an appointment (e.g. due to illness), your deposit will remain valid and will be credited toward the rescheduled appointment.
§ 3 Conclusion of Contract / Contract for Work and Services (Tattoo)
– The tattoo contract is concluded as follows: you book an appointment, during which a consultation takes place. During this consultation, the motif, style, size, placement, and general design framework are determined.
– Upon binding appointment booking and payment of the deposit, a contract for work and services pursuant to § 631 of the German Civil Code (BGB) is concluded.
– The subject of the contract is the creation of an individual artistic work in the form of a tattoo, which is deemed accepted by you upon completion.
§ 4 Prices, Payment and Vouchers
– All prices include the statutory value-added tax.
– The price depends on the duration, complexity of the motif, and the body area to be tattooed, as these factors influence the effort involved.
– All prices quoted during the consultation are non-binding estimates.
– The final price will fall within the previously discussed range and is due immediately after completion of the tattoo. Payment is to be made in cash unless otherwise agreed.
– Installment payments are excluded.
– Vouchers are valid for 24 months from the date of purchase.
§ 5 Design Adjustments and Changes
– Tattoo designs are created individually for you and are generally shown shortly before the appointment.
– Before the tattooing process begins, you may request changes to the design. Minor design adjustments are included in the tattoo contract at no additional cost.
– If the requested changes are so extensive that a complete redesign is required, the paid deposit will be retained as compensation for the time already invested.
– In this case, either a new deposit is required for the appointment or the amount will be added to the final price and paid at the tattoo appointment.
– If no mutual agreement on a design is reached after preparatory work has begun and the appointment is fully cancelled, the deposit will be retained as compensation for the preparatory work.
§ 6 Requirements for Tattooing
– Tattoos are performed exclusively on adults aged 18 or older.
– I reserve the right to verify your age by requesting a valid identification document (ID card or passport).
– A tattoo will only be carried out if you are certain about the design, placement, and execution and have no doubts about your decision.
– I will not tattoo you if:
you appear at the appointment in a hygienically unacceptable condition
you are acutely ill or suffering from a cold
you have taken antibiotics within the last two weeks prior to the appointment
you have undergone surgery within the last four weeks or have surgery planned within four weeks after the appointment
you are pregnant or breastfeeding
you have taken medication within 48 hours prior to the appointment that affects blood clotting or wound healing
you have consumed alcohol or other intoxicating substances within 24 hours prior to the appointment
– If you suffer from skin conditions or other medical issues that could affect the tattooing or healing process, please inform me in advance so we can discuss how to proceed.
– The use of numbing creams or similar products is permitted only after prior consultation.
– I reserve the right to discontinue the tattooing process even after it has begun if your behavior jeopardizes the successful execution of the tattoo. Tattooing generally requires your cooperation over several hours, including the ability to remain calm and still.
– Accompanying persons are permitted only by prior arrangement.
§ 7 Aftercare and Touch-Ups
– One touch-up is included free of charge within 3 months after the tattoo appointment.
– Free touch-ups are excluded in cases of:
improper or negligent aftercare
body areas with generally poor ink retention (e.g. hands or feet)
purely aesthetic change requests without a technical defect
delayed touch-ups (after the 3-month period)
– Exception: If a new tattoo appointment takes place after this period, a small touch-up (up to a maximum of 15 minutes) may be carried out afterward if feasible.
§ 8 Withdrawal, Warranty and Liability
– A tattoo constitutes a permanent artistic alteration of the body. Withdrawal or revocation of the rendered service is excluded.
– Warranty claims are governed by the statutory provisions unless otherwise stipulated in these GTC.
– The final appearance of a tattoo depends on individual factors such as skin condition, healing process, and your behavior during the tattooing process. No liability is assumed for deviations from the design resulting from these factors (e.g. pigment migration, so-called “blowouts”, scarring, or uneven lines). Tattooing over existing tattoos, scars, or laser-treated skin may also affect the result.
– Due to the natural aging process of the skin, the color and shape of the tattoo may change over time.
– Despite professional and hygienic execution, complications may occur (e.g. swelling, redness, itching, pain, circulatory problems, or infections). No guarantee is provided.
– Claims for damages are excluded unless otherwise stipulated below. Excluded from this limitation of liability are claims for damages resulting from injury to life, body, or health, as well as claims arising from the breach of essential contractual obligations. Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract (creation of a tattoo). Liability is also not excluded for damages caused by intentional or grossly negligent misconduct on my part.
§ 9 Miscellaneous and Final Provisions
– You grant me a free, unlimited right in terms of time, location, and content to use, reproduce, and publish photographs and video recordings of the tattoo I have created (e.g. for website, social media, or portfolio purposes).
– I assume no liability for the loss or damage of personal belongings brought into the studio. No compensation will be provided for damage or soiling of clothing, jewelry, or footwear caused by tattoo materials, unless the damage was caused intentionally.
– The contractual relationship is governed exclusively by the laws of the Federal Republic of Germany.
